The following Terms and Conditions (hereafter the “T&C”) define the rights and obligations of UN DRESSING A PARIS LTD. (hereafter “UDAP”) and its customers for the sale of goods and services accessible through this website: [www.undressingaparis.com] (hereafter the “Website”).

Please read these dispositions carefully before using undressingaparis.com website.

By using undressingaparis.com website, customers agree to be bound by the present T&C.
UDAP reserves the right to amend or update its T&C at any time.
Customers are able to acquaint themselves with the current T&C on the website.
They will be requested to confirm their acceptance of the current T&C, without reserves, before any payment will be processed on the website.
The T&C confirmed by the customer during the sale are the applicable T&C.
The data registered by the website stand as a proof of transaction between UDAP and its customers.

II. PRODUCTS

The Goods offered for sale are those featured on the Website.
UDAP makes every effort to accurately describe the Goods and present faithful pictures of its products, as close as possible to original items.
However, minor variations of colours, which customer recognize and accept, may occur on the website, mainly due to technical limitations of some computer equipment or due to specific lighting required during the photo shooting.
The garments from UDAP are handcraft. Created exclusively on the request of the customer, each piece is unique and handmade.
The inherent slight unevennesses of this kind of manufacturing cannot be considered as a major defect.

III. ORDERS

To make an order, customer need to follow the design steps (choice of design, colour(s), optional detail which makes all the difference, size…) and define his way of shipping.

Prior to the placing of the order, a confirmation page will automatically display, showing a photo of the selected item(s), chosen colour(s), chosen quantity, chosen size, the unit price and the total order price, including the shipping price.

Please read this details recap carefully before confirming your order.
The validation of the order serves as the acceptance of the present T&C by the customer.
Order of the Goods will be validated and confirmed after full payment by the Customer i.e once the payment is accepted, the order is effective. It cannot be further modified or nullified.
A confirmation of payment will be sent to the customer by e-mail
The data registered by the website stand as an irrefutable proof of transaction between UDAP and its customers.
Following confirmation and payment, the order will be forwarded to UDAP for manufacturing and dispatching.

At any time, customer can follow-up his order status in the website My Account > Follow my orders

In accordance with the law, UDAP reminds that underage customers need to have a parental agreement to place an order on www.undressingaparis.com

UDAP is entitled to refuse an order made by a Customer in case any dispute arise from the payment of the Goods, or for a previous and litigious order, or for any other reasons related to the respect of the present T&C.

IV. AVAILABILITY

UDAP makes every effort to display only available products and fabrics.

Occasionally, stock issues can occur, usually as a result of simultaneous orders of a given product being processed on the website.
In case of unavailable item, after a placed order, UDAP will inform the customer by email or telephone as promptly as possible.
– If the customer bank account has not been debited, UDAP will notify the customer by email or telephone that the item is not available. Therefore, the order will be cancelled. UDAP will try to guide the customer and will suggest, if possible, a suitable product from the website for replacing the unavailable item.
– If the customer bank account has been debited, UDAP will notify the customer by email or telephone that the item is not available. Customer will have the choice to cancel his order or to choose a replacing product from the website.
– If the customer prefers to cancel his order, UDAP will offer a full refund (including shipping fees). The customer can expect to receive the refund no later than 30 days from the date the initial order was placed.
– If the customer prefers to choose a replacing product from the website, therefore the order is still maintained.
– If the quoted prices of the items selected for replacement have a value exceeding the value of the items being initially ordered, the customer will be required to settle the difference in accordance with the current T&C.
– If the quoted prices of the items selected for replacement have a value lower than the value of the items being initially ordered, the price difference will be refunded by UDAP in accordance with the current T&C. The customer can expect to receive the price difference no later than 30 days from the date the initial order was placed.

UDAP reserves the right to change, at any time and without advanced notice, the items displayed on its website.

V. PRICES

Prices displayed on the website are in Euros, all taxes included, but delivery fees excluded.
The global price of the order (Products and shipping) is stipulated before checking out.
The payment confirmation sent to the customer includes both UDAP products and shipping price.
In some countries, custom fees or local taxes could be required. They will be the responsibility of the customer.
UDAP reserves the right to modify at any time, and without advanced notice, the prices of its products.
Prices invoiced to the Customer are those applicable at the date of order.

VI. PAYMENT

Payments must be done in the currency displayed during the order (Euros) by credit card or Paypal.
If the customer uses Paypal as payment method, the customer will be redirected to his Paypal account.
Debit/credit cards allowed are: Visa, Mastercard, Amex, UnionPay and Discover.
Payments performed on the website are totally safe and secure.
All products are owned by UDAP until the payment is confirmed.
If a purchase is rejected from the bank, the order is automatically cancelled.

VII. SHIPPING & DELIVERY

UDAP delivers worldwide.
Products are shipped to the delivery address registered by the customer during the order process.
All items purchased will be shipped together in one package.
The shipping price remains the same, whatever the number of product items in the order.
Every order exceeding 185€ is free standard shipping.
The customer have the choice between two delivery methods.
Specific price and delay for each country and each method is displayed on the website during the order process.

Proposed delivery methods are the following:
– Standard Delivery through AMR (Air Mail Registered) service by Thailand Post
The order is delivered within a maximum of 3 weeks from the day of the order, including manufacturing time which is approximatively 1 week.
This delay can be shorter depending on the country of delivery.
– Express Delivery through EMS (Express Mail Service)
The order is delivered within a maximum of 15 days from the day of the order, including manufacturing time which is approximatively 1 week.
This delay can be shorter depending on the country of delivery.

In case the country of delivery is not covered by EMS, or for any special request or emergency, the customer can feel free to write to UDAP at the following address: [email protected]. UDAP will do the best to satisfy the customer.

At any time, customer can follow-up his order status on the website My Account > Follow my orders
Moreover, a tracking number will be sent to the customer to track the delivery.

If the customer do not receive his order in due time, the order cannot be cancelled but it is recommended to contact UDAP as prompt as possible through the “My orders” part on the website or at: [email protected]. In this case, the customer should indicate in his email: reference of the Good(s), tracking number of the order, name and address of delivery.

UDAP shall not be held liable for late delivery, lost or damaged parcel by courier services, which are not due to UDAP’s wrongdoing.
The customer should contact Thailand post and provide them with the tracking number. If Thailand post cannot solve the problem, the customer can contact UDAP through the “My orders” part on the website or at: [email protected].

In some countries, custom fees or local taxes could be required. UDAP shall not be held responsible for any taxes related to or in connexion with custom regulations, potentially applicable on the goods. They will be the responsibility of the customer.

Delivery is effective as soon as the product is delivered at the customer’s address.

VIII. REVOCATION & RETURN POLICY

UDAP cannot modify or cancel an order once processed for production.
In case of either changing or cancelling, the customer can email UDAP at [email protected] to see if the order has been sent to production. If not, UDAP is able to modify or cancel the order.

Customers must consider that UDAP manufactures custom-made garments exclusively for the customer. Each item is manufactured on the specific request of each customer.
Consequently, UDAP only agrees returns if the delivered product is not the one ordered (i.e wrong item / Colour(s) / Size)

In this case, Customer can email UDAP at [email protected] within 14 days upon reception of his package.
UDAP will inform the customer about the address where return the non-complying product.
Customer returning any items is required to write a letter enclosed with the original order, indicating the reasons of the return.
The item Customer wishes to return should be in its original condition: not worn, not altered… If the product has been worn or damaged, UDAP will not accept the return. UDAP has final discretion in deciding if returned items are in their original condition when received and if they fulfil the above conditions.

Upon reception and approval of the return product by UDAP, UDAP will propose 2 choices to customer:
– To have a refund of his original order including delivery shipping price and shipping fees for the return (based on presentation of receipt). The refund will be processed no later than 30 days after receipt of returned goods.
Or
– To replace the non-complying product by a substitution product.
If the quoted prices of the items selected for exchange have a value exceeding the value of the items being returned, the customer will be required to settle the difference in accordance with the current T&C.
If the quoted prices of the items selected for exchange have a value lower than the value of the items being returned, the price difference will be refunded by UDAP in accordance with the current T&C. The customer can expect to receive the price difference no later than 30 days from the date the returned product is approved by UDAP.

The shipping fees of the replacement good will be at the charge of UDAP, as a commercial gesture.

UDAP will not be responsible in case of losses of merchandise arising from an incorrect address being provided, or for the delay in return delivery, in-so-far as the inherent risks taken and undertaken in return shipping of items for exchange/refund rest solely with customer.

IX. APPLICABLE LAW AND JURIDICTION

The present T&C are established in accordance with the laws of [Hong-Kong SAR].

In the event, that a dispute arise in connection with the present T&C, UDAP and the Customer agree to attempt to amicably solve the dispute, before any further legal proceedings. Failing that, the courts of [Hong-Kong SAR] shall have exclusive jurisdiction.

II. SECURITY AND CONFIDENTIALITY

It is Customer responsibility to make all appropriate efforts to protect its data and/or software while surfing on Internet.

All customer data are securely stored and can be accessed only by UDAP. Customer personal data will not be sold or transfer to any third parties companies.

Customer banking and payment information are not in UDAP’s possession since all transactions are processed through PayPal©.

The website undressingaparis.com is not intended for use by minors.

III. INTELLECTUAL PROPERTY

All the elements (drawings, illustrations, images, sound tracks, texts, logos, and branded merchandise…) that constitutes the website undressingaparis.com remains the exclusive property of UN DRESSING A PARIS LTD.
